Obama and various members of his staff had repeatedly stated that they are not keeping an "enemies list". So either the President is telling the truth and is not keeping names which means the President and his staff are violating Federal law. OR they really are keeping names which means the president is lying to the American public. Don't we have an impeachment law for that kind of thing?.
You see the Obama White House is not covered by the Freedom of Information Act, which means he/ they keep the names on the database secret for political purposes. BUT the Presidential Records Act requires the White House to preserve its records without having to release them to the public for more than ten years.
The Presidential Records Act (PRA) of 1978, 44 U.S.C. ß2201-2207, governs the official records of Presidents and Vice Presidents that were created or received after 20 January 1981. The PRA established a new structure for managing Presidential records and changed their ownership from private to public. Its passage was triggered by the Watergate scandal.
This means the White House is actually keeping those records, they are required to do so by federal law.. So either Obama and his staff are violating Federal law by getting rid of that information or he is lying plain and simple and could face impeachment proceedings
Think about the broad level of access. Those records may be assessed by members of the presidential staff to determine if "threat" exists , a very nebulous term. In fact those records could be passed along to various security entities like FBI,CIA, Secret Service, Various branches of military intelligence if the person being "snitched on" for having a different view that the White House on Health care. Sounds like the 1950's and McCarthyism and the communist witch hunts or the old Nixon days!
So if the Obama Administration isn't "taking names' , they are violating federal law by destroying them.
Obama says he isn't taking names, So IF we take him at his public word given at the town hall, that's means he is in violation of Federal law, you can be impeached for that.
Article 2 : Section 4. The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.
Violation of The Presidential Records Act (PRA) of 1978, 44 U.S.C. ß2201-2207 would certainly meet the level of proof for impeachment.
